Sighost.com user Agreement

This agreement describes the terms and conditions of your use of the services of Sighost.com.
By registering with Sighost.com you agree to these terms. If you do not agree, you may not use
our services. We may amend this agreement at any time by posting amended terms on our site and
notifying users.
Eligibility Sighost services are available only to individuals who may legally form a binding contract under California law. By accepting this agreement, you confirm you are 18 years of age or older and authorized to enter into a contract. You agree to : - Provide complete profile information and update it as required to maintain accuracy. - Not transfer or sell your sighost.com account to another party. - Not register more than one account to avoid paying fees. Sighost.com may terminate the account of anyone who refuses to fulfill the above and reserves the right to refuse service to anyone suspended from Sighost for any reason in the past. Acceptable use You agree to use Sighost.com only for the uses of uploading, editing and linking to images as made available by the site interface. You agree to keep your user name and password confidential and not share your account privileges with any third party. You agree not to use any script or process to attempt to interfere with the operation of our servers or knowingly take any action which imposes an unreasonable load on our servers (see Bandwidth). You may not upload pornographic images or copyrighted images which you do not possess rights to distribute. These will be removed without notice. All content on our website (other than user directories) is the property of SRO Software and is protected by United States copyright law. Free accounts are limited to one per person and duplicate accounts will be deleted without notice. Payment Terms We do not invoice. All hosting accounts must be prepaid in advance of the hosting period and any unpaid accounts will be suspended. Sighost.com accepts credit card, Paypal, check and money order payments. All checks are held until cleared, after which your account will be credited. Privacy Sighost.com will NEVER sell, rent or otherwise provide your personal information to any third party for ANY purpose without your consent unless we are ordered to do so by a court of law. Sighost will also maintain records in such a manner as to not be easily accessible to any abusive individual, agency or the general public. Warranty/Liability/Indemnity Sighost.com provides web site and services "AS IS" with no warranty expressed or implied. Some states do not allow the disclaimer of implied warranties, so this may not apply to you. In no event shall sighost.com, SRO Software or our suppliers be liable for lost profits or any other consequential damages which might arise from or in connection with our site or services. While Sighost.com will make every attempt to provide a reliable and secure hosting environment, this may be affected by many factors outside of our control and we do not guarantee continuous or uninterrupted access to our services, nor do we guarantee availability or integrity of data. You agree to indemnify and hold Sighost.com and SRO Software harmless from any claim or demand, including reasonable attorney fees, made by any third party due to or arising from your breach of this agreement. Additional terms Each account has specific limits of image size, disk space and bandwidth. Users agree to familiarize themselves with these limits (found here) and maintain their accounts in such a manner as to stay within these limits. If at any time a user exceeds these limits, Sighost reserves the right to resize or compress images and/or restrict access to the account to avoid excessive bandwidth usage. General This agreement is governed by the laws of the State of California. If any part of the agreement is found to be invalid or unenforceable, such item shall be struck and the remaining provisions enforced. You agree that this agreement may be assigned by SRO Software, in our sole discretion, to a third party in the event of a merger or acquisition.
